How Dauntless ensures compliance with the Telephone Consumer Protection Act (TCPA)

Overview

The Telephone Consumer Protection Act (TCPA) regulates telemarketing calls, auto-dialed calls, prerecorded calls, text messages, and unsolicited faxes. Dauntless, operated by Dauntless Systems LLC (672 N University Ave, B116, Provo, UT 84601), is designed with TCPA compliance built into every step of contact entry and follow-up across both products: Follow-Up (sales teams messaging customers who agreed to a text in person) and Winback (internet service providers messaging their own former customers).

Basis for Contact

Before any text message is sent through Dauntless, one of the following must be true and on record:

  • Express consent in person (Follow-Up): The sales representative confirms with the customer that they agree to receive text messages, then records that consent in the app before saving the phone number — creating a timestamped consent record. The system will not queue messages for any contact without the consent flag.
  • Express written consent online: Customers may also opt in directly through our consent form at dauntlessfiber.com/consent, which records the exact disclosure they agreed to.
  • Prior business relationship (Winback):Winback messages go only to a provider's own former customers — people with a prior, direct business relationship with the sending provider — under that provider's own registered brand and campaign.

Opt-Out Mechanism

Every automated text message sent through Dauntless includes clear opt-out instructions. Recipients can opt out at any time by:

  • Replying STOP to any message
  • Replying UNSUBSCRIBE, CANCEL, QUIT, or OPT OUT

When an opt-out is received:

  • All scheduled messages to that number are immediately cancelled
  • The contact is marked as opted out in the system
  • A confirmation message is sent: "You've been unsubscribed. You won't receive any more messages."
  • No further messages can be sent to that number through the platform
  • For Winback, the opt-out is synced back to the sending provider

Message Content

All automated messages sent through Dauntless:

  • Identify the sender — the rep's name and company (Follow-Up) or the provider's brand (Winback)
  • State the purpose of the message
  • Are conversational and non-deceptive in nature
  • Do not contain misleading claims about pricing, availability, or offers
  • Are sent only during permitted hours (below)

Sending Hours

Automated messages are only sent between 9:00 AM and 8:00 PM in the recipient's local time zone — narrower than the TCPA's 8 AM – 9 PM requirement. The system determines the recipient's time zone before sending and holds anything that falls outside the window.

Record Keeping

Dauntless maintains records of:

  • The basis for contact — the date, time, and manner consent was obtained, or the provider relationship behind a Winback record
  • Who recorded the consent (Follow-Up) or uploaded the record (Winback)
  • Every message sent and received, with timestamps
  • All opt-out requests and the date they were processed

These records are retained for a minimum of 5 years and are available for compliance audits.

Do Not Contact List

Phone numbers that have opted out are added to an internal Do Not Contact list, checked before any message is sent. Numbers on this list cannot be re-added to messaging without new, documented consent.

Customer Responsibility

While Dauntless provides the technical infrastructure for TCPA compliance, each organization using the platform is responsible for:

  • Training reps on proper consent collection (Follow-Up)
  • Ensuring uploaded records are its own customers, collected lawfully (Winback)
  • Monitoring compliance within its organization
  • Responding to consumer complaints promptly
